MANILA, Philippines- Nanindigan ang Court of Appeals (CA) sa 2023 decision nitong bumabasura sa petition for mandamus ng NOW Telecom Company Inc. laban sa National Telecommunications Commission (NTC) ukol sa aplikasyon ng telco para sa cellular mobile telephone service gamit ang partikular na frequency ranges.
Sa four-page resolution, ikinasa noong February 29, 2024, ibinasura ng Special Ninth Division ng CA ang motion for reconsideration na inihain ng NOW Telecom upang mabaligtad ang September 2023 ruling ng Appellate court.
Sa pagtabla sa petisyon ng telco, binanggit ng CA na ang mga puntong iprinisenta ng NOW Telecom sa mosyon nito ay “mere rehash” ng mga argumentong inilatag nito sa nauna nitong petition for mandamus.
“Clearly, NOW Telecom failed to raise new issues, interpose new compelling arguments or present new credible evidence in its MR which would warrant a reconsideration or reversal of Our Decision,” anang CA sa resolusyong isinulat ni Associate Justice Tita Marilyn Payoyo-Villordon at pinagtibay nina Associate Justices Myra Garcia-Fernandez at Walter Ong.
