MANILA, Philippines- Sinimulan na ng Sandiganbayan ang paglilitis nito sa graft charge sa umano’y irregular transfer ng P41.4 bilyong Covid-19 funds na inihain laban kina dating Department of Health (DOH) secretary Francisco T. Duque III at Procurement Service – Department of Budget and Management (PS-DBM) Undersecretary Lloyd Christopher A. Lao.
Matapos ang raffle nitong Biyernes, ini-refer na ang kaso sa first division ng anti-graft court na tutukoy ng probable cause para sa pagpapalabas ng arrest order.
Inirekomenda naman ng Office of the Ombudsman (OMB) ang piyansang tig-P90,000 para kina Duque at Lao.
Kinasuhan sina Duque at Lao ng paglabag sa Section 3(e) ng Republic Act No. 3019, ang Anti-Graft and Corrupt Practices Act, para sa umano’y irregular transfer ng P41.464 bilyong DOH funds sa PS-DBM mula Marso hanggang Disyembre 2020.
Sa charge sheet na inihain ni Graft Investigation and Prosecution Officer III Napoleon Regan D. Malimas noong Agosto 27, sinisi ng state prosecutors si Duque sa fund transfers na nagkakahalaga ng P41,463,867,117.52 sa PS-DBM “despite the obligation of DOH to directly and expeditiously procure the Covid-19 medical supplies and equipment requested by the end-user offices to address the pandemic.”
Nakalaan ang pondo para sa agarang pagbili ng detection kits, nucleic acid extraction machine, mechanical ventilator, personal protective equipment (PPE), surgical mask, cadaver bag, at various test kits.
Ani Malimas, hindi umano napakabilis ng ng kasunduan ng DOH sa PS-DBM ang project implementation, dahil ang PS-DBM ay walang hawak na mga nasabing medical items sa imbentaryo na ito.
Sa kaso ni Lao, nakasaad sa kaso na tinanggap niya ang transfers “notwithstanding non-compliance with the aforementioned procurement law, rules and issuances as well as the afore-cited accounting and auditing rules on transfer of funds from one agency to another.”
Naningil din umano ang PS-DBM ng 4 porsyentong service fee na nagkakahalaga ng P1,658,554,684.70, na kinuha mula sa pondo ng DOH, batay sa charge sheet. Dahil dito, nagdulot ito ng “undue injury” sa DOH at sa end-user offices at bureaus, anito pa.
