MANILA, Philippines – Tinanggihan ng Senate impeachment court nitong Miyerkules, Agosto 5, ang pagtutol ng defense team ni Vice President Sara Duterte sa pagmamarka ng bahagi ng affidavit ni self-confessed Davao Death Squad (DDS) member Arturo Lascañas bilang isang prosecution exhibit.
Ang ruling ay isinagawa ni court presiding officer Senador Francis “Chiz” Escudero sa ika-13 araw ng impeachment trial ni Duterte.
“After considering the objections of the respondent, the objection is hereby denied,” ani Escudero.
Habang pinapayagan ang physical transfer ng markings, sinabi ni Escudero na malinaw na dinesisyunan ng korte ang naturang usapin bilang “mechanical and ministerial act.”
Aniya, ang dokumento ay hindi maikokonsiderang ebidensya hanggat hindi pormal na inaalok sa ilalim ng Section 34, Rule 132 ng Rules of Court.
Sinabi rin ni Escudero na ang dokumento ay nananatiling fatally defective dahil ito ay “unsigned, unnotarized, and not made under oath.”
Nitong Martes, iginiit ni lead defense counsel Sheila Sison na ang affidavit ni Lascañas, na binasa sa rekord, ni National Bureau of Investigation (NBI) Director Melvin Matibag, ay
unnotarized at hindi tinukoy ng sinumang
competent witness.
Nauna nang sinabi ni Matibag na tiningnan ng NBI ang affidavit ni Lascañas na ipinasa sa International Criminal Court (ICC), na nagbanggit sa umano’y kaugnayan ni Vice President Sara Duterte sa Oplan Tokhang. RNT/JGC
