MANILA, Philippines – Iniutos ng Supreme Court na maging regular ng nasa 7,000 ‘contractual employees’ ng PLDT Inc. na nagtatrabaho sa hanay ng line installation, repair, at maintenance.
Sa desisyon ng SC First Division kinatigan nito ang ruling ng Court of Appeals (CA) na nagdedeklara na lumabag sa labor laws ang PLDT at contractor nito.
Ibinasura ng SC ang pinagsamang petitions for review on certiorari ng Manggagawa sa Komunikasyon ng Pilipinas, PLDT, at Silvestre Bello Ill na dating kalihim ng Department of Labor and Employment (DOLE).
Ayon sa First Division ang mga naggatrabaho sa ilalim ng installation, repair at maintenance services ng PLDT lines ay direktang may kaugnayan sa mismong negosyo ng kumpanya.
Binigyan-diin ng SC na nasa ilalim ng Article 295 ng Labor Code na ang regular employment ay ang koneksyon ng trabaho ng isang employee sa negosyo ng employer.
“It cannot be denied that without the work performed by these employees, PLDT would not be able to carry-on its business and deliver the services it promised its consumers,” nakasaad sa desisyun.
Samantala, ibinalik ng SC sa Regional Director ang kaso para sa tamang pagrepaso at pagbatid ng mga isyu.
“As the regularization of these employees entails factual consequences that cannot be determined by the Court, the case was remanded to the Regional Director for proper identification, review, and determination of the factual issues.”
Inatasan rin ng Korte ang Regional Director na pag-aralan at alamin ang epekto ng regularization ng mga mangagawa na nasa hanay ng installation, repair, at maintenance services;l.
Kailangan din irebyu at icompute ng Regional Director ang nararapat na monetary award dahil sa mga nilabag na labor standards ng PLDT, Inc., at mga contractor nito. Teresa Tavares
