MANILA, Philippines – Kinuwestiyon ni Senador Alan Peter Cayetano ang pagpapadala kay dating Pangulong Rodrigo Roa Duterte direkta sa International Criminal Court (ICC) sa The Hague na itinuturing nitong walang due process at magamit ang lahat ng pamamaraang legal sa loob ng bansa.
Sa ganitong punto, pumalag si dating Senador Leila De Lima sa pananaw ni Cayetano sa pagsasabing na kinikilala ng Pilipinas ang hurisdikyon ng ICC hinggil sa crimes against international humanitarian law, genocide at iba pang krimen laban sa sangkatauhan.
“The enemies of President Duterte, from legitimate human rights lawyers, former Senator de Lima, those from the Philippine left groups, they are a lot, basically rejoicing. And I respect their rights, they fought for their human rights,” ayon kay Cayetano.
“But aren’t human rights [a matter of] due process?” dagdag niya.
Mahigpit na kaalyado ni Cayetano ang mga Duterte, katunayan siya ang katambal ng dating chief executive noong 2023 national elections, at naitalaga bilang kalihim ng Department of Foreign Affairs (DFA).
Sinabi ni Cayetano na walang korte sa Pilipinas na nag-utos upang arestuhin si Duterte kahit may ICC warrant at binasahan siya ng Miranda rights.
“What happened to human rights advocates? No wonder, si Kitty, sabi niya this is the plane na kinidnap yung tatay ko,” ayon kay Cayetano.
Ngunit, ipinaliwanag naman ni De Lima si Cayetano sa pagsasabing nakatakda sa Republic Act No. 9851 na may option ang gobyerno ng Pilipinas na isuko si Duterte sa ICC kahit walang kautusan na magmumula sa Korte.
Nanguna si De Lima sa pag-iimbestiga sa Davao Death Squad nang maitalaga ito bilang chairperson ng Commission on Human Rights.
“RA 9851 says that the Philippine government has the option to surrender Duterte to the ICC without any judicial approval,” ayon kay De Lima said.
“Kung may problema ka sa batas na ito, Alan Peter, ipadeklara mong unconstitutional sa Korte Suprema. Until that time, stop lecturing and whining to us,” Patutsada ng dating senador na tumatakbong kinatawa ng Mamamayang Liberal Party List sa Kongreso.
Sa kautusan noong Marso 2021, sinabi ng Supreme Court na may obligasyon ang Pilipinas na makipagtulungan sa ICC kahit kumalas ito sa Rome Statute noong 2019.
“Consequently, liability for the alleged summary killings and other atrocities committed in the course of the war on drugs is not nullified or negated here. The Philippines remained covered and bound by the Rome Statute until March 17, 2019,” ayon sa SC.
Nakakulong ngayon si Duterte, magiging 80 anyos sa Marso 28, sa The Hague Penitentiary Institution o ang Scheveningen Prison na kung saaan gagawin ang paglilitis ng ICC.
Base sa warrant of arrest na ipinalabas ng pre-trial chamber ng ICC laban kay Duterte na may “reasonable ground to believe Duterte was “individually responsible for the crimes against humanity of murder” in connection with the killings in the anti-drug campaign.”
“Taking into account the totality of the information before it, the Chamber finds reasonable grounds to believe that Mr. Duterte is individually responsible for the crime against humanity of murder as an indirect co-perpetrator within the meaning of Article 25 (3)(a) of the Statute, committed during the relevant period,” ayon sa dokumento na inihain kay Duterte.
